There continues to be a debate on whether addiction is best understood as a brain disease or a moral condition. This debate, which may influence both the stigma attached to addiction and access to treatment, is often motivated by the question of whether and to what extent we can justly hold addicted individuals responsible for their actions. In fact, there is substantial evidence for a disease model, but the disease model per se does not resolve the question of voluntary control. (...) Recent research at the intersection of neuroscience and psychology suggests that addicted individuals have substantial impairments in cognitive control of behavior, but this “loss of control” is not complete or simple. Nietzsche was a philosopher who prided himself, in deliberate contradistinction with previous philosophers, on his ‘historical sense’. But this leaves many questions unanswered about the precise role of the historical in Nietzsche’s philosophy. Perhaps most importantly, can the conception of genealogy in Nietzsche’s later philosophy, as a revised historical method, be taken to represent his mature philosophical methodology in general? I argue, firstly, that there is considerable continuity between Nietzsche’s conceptions of history in the early essay ‘On the uses and (...) disadvantages of history for life’ and those of his later philosophy. The former can therefore be used as a resource for understanding the latter. Through a reading of the early history essay I demonstrate that Nietzsche’s conception of the historical here is intimately bound up with the notion of the ‘unhistorical’ and that it is precisely renewed access to the unhistorical which is required in order for history to be conducive to the flourishing of humanity. I go on to contend that this holds for Nietzsche’s later writings as well, and that genealogy, being purely historical, must therefore be seen as one subsidiary part of a broader philosophy in which the unhistorical will play, literally, a vital role. In the past thirty years or so, the doctrine that actions are events has become an essential, and sometimes unargued, part of the received view in the philosophy of action, despite the efforts of a few philosophers to undermine the consensus. For example, the entry for Agency in a recently published reference guide to the philosophy of mind begins with the following sentence: A central task in the philosophy of action is that of spelling out the differences between events in (...) general and those events that fall squarely into the category of human action. There is no consensus about what events are. But it is generally agreed that, whatever events may prove to be, actions are a species or a class of events. We believe that the received view is mistaken: actions are not events. We concede that for most purposes, the kind of categorial refinement which is involved in either affirming or denying that actions are events is frankly otiose. Our common idiom does not stress the difference between actions and events, at least not in general terms, because it has no need to. Perhaps it sounds a little odd to say that some events are performed; but if we balked at describing, say, the abdication of Edward VIII as one of the politically significant events in Britain in 1936, it could not be for metaphysical reasons. And since actions, like events, are datable — though often, as we shall see, only imprecisely — actions are said to take place and to occur. But an important class of actions consist in moving something; indeed, according to many philosophers, every action consists in moving something. And when we consider actions of this sort from a theoretical point of view it becomes imperative to distinguish between actions and events. Or so we shall argue. (shrink)

Nelson Goodman's own solution to his new riddle of induction turns on the degree to which predicates are entrenched in our use of language. However, this solution requires that judgements concerning the degree to which a predicate is entrenched can be made independently of any canon of perceptible similarity. I argue that this requirement cannot be met. The riddle itself depends upon the claim that since ‘green’ can be defined positionally in terms of ‘grue’ and ‘bleen’, ‘grue’ and ‘bleen’ are (...) symmetrically related to ‘green’ and ‘blue’, and positionality is therefore ‘an entirely relative matter’. However, in order to establish that positionality is an entirely relative matter, we would need to provide a non‐positional definition of ‘grue’, rather than a positional definition of ‘green’. We therefore need to decide whether ‘grue’ can be defined ostensively by means of a single sample, as ‘green’ can. I argue that any attempt to provide such a definition is bound to fail, and hence the new riddle of induction does not reveal that ‘the roots of inductive validity are to be found in our use of language’. Priority setting in health care is ubiquitous and health authorities are increasingly recognising the need for priority setting guidelines to ensure efficient, fair, and equitable resource allocation. While cost-effectiveness concerns seem to dominate many policies, the tension between utilitarian and deontological concerns is salient to many, and various severity criteria appear to fill this gap. Severity, then, must be subjected to rigorous ethical and philosophical analysis. Here we first give a brief history of the path to today’s severity criteria in (...) Norway and Sweden. The Scandinavian perspective on severity might be conducive to the international discussion, given its long-standing use as a priority setting criterion, despite having reached rather different conclusions so far. We then argue that severity can be viewed as a multidimensional concept, drawing on accounts of need, urgency, fairness, duty to save lives, and human dignity. Such concerns will often be relative to local mores, and the weighting placed on the various dimensions cannot be expected to be fixed. Thirdly, we present what we think are the most pertinent questions to answer about severity in order to facilitate decision making in the coming years of increased scarcity, and to further the understanding of underlying assumptions and values that go into these decisions. We conclude that severity is poorly understood, and that the topic needs substantial further inquiry; thus we hope this article may set a challenging and important research agenda. (shrink)

In Norway, priority for health interventions is assigned on the basis of three official criteria: health benefit, resources, and severity. Responses to the COVID-19 pandemic have mainly happened through intersectoral public health efforts such as lockdowns, quarantines, information campaigns, social distancing and, more recently, vaccine distribution. The aim of this article is to evaluate potential priority setting criteria for public health interventions. We argue in favour of the following three criteria for public health priority setting: benefit, resources and improving the (...) well-being of the worse off. We argue that benefits and priority to the worse off may reasonably be understood in terms of individual well-being, rather than only health, for public health priority setting. We examine two competing solutions to Benardete paradoxes: causal finitism, according to which nothing can have infinitely many causes, and the unsatisfiable pair diagnosis (UPD), according to which such paradoxes are logically impossible and no metaphysical thesis need be adopted to avoid them. We argue that the UPD enjoys notable theoretical advantages over causal finitism. Causal finitists, however, have levelled two main objections to the UPD. First, they urge that the UPD requires positing a ‘mysterious force’ that prevents paradoxes from (...) arising. Since such a force is implausible, the UPD is in trouble. Second, they employ recombination or patchwork principles to argue that paradoxical situations would be possible if causal finitism were false. Since such situations are not possible, causal finitism is true, and so a substantive metaphysical thesis is needed to avoid the paradoxes. We argue that the UPD proponent can successfully respond to these objections. (shrink)

Durante la edad escolar, los sujetos van logrando una madurez sintáctica, evidenciada en el incremento de lacomplejidad estructural de los textos que producen. Diversas teorías han dado cuenta de dicha complejidad(Hunt, 1970; Katzenberger, 2004; Nir & Berman, 2010), sosteniendo que la misma está vinculada con eltipo de relaciones interclausulares dentro del texto. Asimismo, corroboran que dicha complejidad no sólo seincrementa con el nivel educativo, sino también está guiada por la modalidad discursiva. A partir de estapropuesta, el proyecto FONDECYT 1100600, se (...) planteó el objetivo de describir el desarrollo de la sintaxisoral, considerando otra perspectiva de la complejidad: la diversidad interclausular. Para ello, se aplicarondos tareas de elicitación (narración y explicación), a 250 estudiantes de kinder, 3º y 6º básico, Iº y IVº mediode Valparaíso y Santiago. Luego de ser transcritos y analizados, se reconocieron en los textos las relacionesinterclausulares y se estableció un índice de diversidad clausular, en el entendido de que a medida que seusaban más formas para relacionar las cláusulas, mayor sería la complejidad sintáctica de los mismos. Losresultados muestran un incremento de la diversidad clausular a medida que aumenta el nivel educativo, sinembargo, su significatividad se da sólo entre algunos niveles. Además, entre ambos tipos de textos no semanifiestan grandes diferencias, salvo en Kínder y en IVº Medio. Estos hallazgos permiten vislumbrar que lamadurez sintáctica implica tener mayor cantidad de estructuras gramaticales y utilizarlas estratégicamentepara construir un determinado texto. (shrink)

The practical goal of preventing premature death seems uncontroversial. But the term ‘premature death’ is vague with several, sometimes conflicting definitions. This ambiguity results in several conceptions with which not all will agree. Moreover, the normative rationale behind the goal of preventing premature deaths is masked by the operational definition of existing measures. In this article, we argue that ‘premature death’ should be recognized as a normative concept. We propose that normative theories should be used to justify measures of premature (...) death to provide them with normative validity and public legitimacy. (shrink)

In their important book, Causation in the Law, H. L. A. Hart and Tony Honore argue that causation in the law is based on causation outside the law, that the causal principles the courts rely on to determine legal responsibility are based on distinctions exercised in ordinary causal judgments. A distinction that particularly concerns them is one that divides factors that are necessary or sine qua non for an effect into those that count as causes for purposes of legal responsibility (...) and those that do not. Hart and Honore claim that this distinction is often one of fact rather than of legal policy, and that the factual basis is to be found in the ordinary distinction we draw between causes and 'mere conditions'. If this claim is correct, we may hope to illuminate the legal distinction by articulating the principles behind the ordinary one. This is a challenging task since, as in the case of most cognitive skills, we are far better at making particular judgments than we are at stating the general principles that underlie them. Hart and Honore devote the first part of their book to this difficult task. We have, then, two large projects. One is to articulate our ordinary notion of causation, especially the distinction between cause and mere condition. This is the project of constructing an 'ordinary model'. The other is to argue for what we may call the 'shared concept claim', the claim that the concept of legal cause is based on the ordinary notion of causation, that 'causal judgments, though the law may have to systematize them, are not specifically legal. They appeal to a notion which is part of everyday life' (1985, p. lv; all references to follow are from this edition). This essay will focus on Hart and Honore's ordinary model, rather than on their shared concept claim. In my judgment, Hart and Honore's case for some version of the shared concept claim is strong, so they are right to maintain that a better understanding of our ordinary notion of.. (shrink)

It is plausible to think that practices of caring are partly constituted by a caregiver's commitment to a cared-for. However, discussions of caring often contain no explicit discussion of such commitments, and do not attempt to draw any philosophical conclusions from the nature of caring relations as committed. A discussion of caring practices that emphasizes the importance of commitment therefore has the potential to generate important new insights for our understanding of caring. This essay begins that project by arguing that (...) a commitment-centric conception of caring entails the truth of moral partialism. Although many care-ethicists are sympathetic to partialism, the arguments in its defense remain controversial. As I show in this article, however, partialism is necessarily true given the committed nature of caring. This is because the concept of commitment is itself a necessarily partial one: to say that we are equally committed to everyone or everything is equivalent to saying that we are not committed to anything. Thus, when viewed as a species of commitment, it is part of the concept of caring that it requires us to put the needs of those we care for before the needs of those unknown to us. (shrink)

In a recent extended essay, philosopher Daniel Hausman goes a long way towards dismissing severity as a morally relevant attribute in the context of priority setting in healthcare. In this response, we argue that although Hausman certainly points to real problems with how severity is often interpreted and operationalised within the priority setting context, the conclusion that severity does not contain plausible ethical content is too hasty. Rather than abandonment, our proposal is to take severity seriously by carefully mapping the (...) possibly multiple underlying accounts to well-established ethical theories, in a way that is both morally defensible and aligned with the term’s colloquial uses.
